These Terms of Service ("Terms") govern your access to and use of the services, courses, and educational materials provided by AI Academy Asia ("we," "us," or "our"). By accessing or using our services, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use our services.

1. Acceptance of Terms

By registering for, accessing, or participating in any course or service offered by AI Academy Asia, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. These Terms constitute a legally binding agreement between you and AI Academy Asia.

2. Educational Services and CPD Alignment

• AI Academy Asia provides professional development training programs and educational courses for youth. Our professional development training programs are designed to meet international standards for Continuing Professional Development (CPD).
• CPD Accreditation: Our "AI4Corporate for LEADERS" course is undergoing assessment for CPD accreditation. Accreditation status will be updated on our website and communicated to enrolled participants.
• Certification Criteria: Certificates of completion are issued based on:
  • Meeting minimum attendance requirements as specified for each course
  • Successful submission and approval of any required capstone projects or assessments
  • Compliance with course participation requirements
• Assessment Methods: We do not use traditional knowledge tests or quizzes. Assessment is based on practical application, project work, and demonstrated understanding of course materials.
• No Guarantee of Outcomes: While our courses are designed to professional standards, we make no guarantees regarding specific career outcomes, job placements, or professional advancement resulting from course completion.

3. Registration and Enrollment

• Eligibility: You must be at least 18 years of age to register for our professional development courses. For youth programs, educational courses for teens and children, parental or guardian consent is required for participants under 18 years of age. By registering, you represent and warrant that you meet the applicable age requirement or have obtained necessary parental/guardian consent.
• Accurate Information: You agree to provide accurate, current, and complete information during registration and to update such information as necessary.
• Account Security: You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.

4. Payment Terms and Refund Policy

• Course Fees: Course fees will be communicated to you during the registration process or upon inquiry. For some courses, a minimum deposit of 20% of the total fee is required to secure your enrollment, with the balance due according to the payment schedule provided. Full payment may be required for other programs, unless alternative payment arrangements have been agreed upon in writing.
• Payment Methods: We accept payment methods as displayed during the registration process. All payments are processed securely through our payment service providers.
• Refund Policy: Refund eligibility and terms vary by course and will be specified at the time of registration. Generally:
  • Cancellations made more than 14 days before the course start date may be eligible for a full refund
  • Cancellations made 7-14 days before the course start date may be eligible for a partial refund
  • Cancellations made less than 7 days before the course start date are generally not eligible for a refund
• Course Cancellation by AI Academy Asia: We reserve the right to cancel or reschedule courses due to insufficient enrollment or unforeseen circumstances. In such cases, enrolled participants will receive a full refund or the option to transfer to a future session.

5. Use of AI Tools and Generated Content

• Educational Purpose: All AI tools, platforms, and generated content provided during our training programs are for educational purposes only.
• Professional Verification Required: AI-generated outputs demonstrated or created during courses must always be verified, validated, and reviewed by qualified human professionals before being used in any professional, commercial, or decision-making context.
• No Liability for AI Tool Outcomes: AI Academy Asia is not liable for any outcomes, decisions, or consequences resulting from the use of AI tools, techniques, or methodologies discussed or demonstrated in our courses. Users are solely responsible for their application of learned knowledge.
• Third-Party AI Services: Some courses may involve the use of third-party AI platforms or services. Your use of such services is subject to the respective third-party terms and conditions.
• Ethical Use: Participants are expected to use AI tools ethically and in compliance with applicable laws, regulations, and professional standards.

6. Data Protection and Privacy

AI Academy Asia is committed to protecting your personal data in compliance with:

• The Mongolian Law on Personal Data Protection 2021
• Other International data protection standards and best practices

• Ownership: All course materials, including but not limited to lesson plans, slides, videos, handouts, software, and documentation ("Course Materials"), are the intellectual property of AI Academy Asia or our licensors and are protected by copyright, trademark, and other intellectual property laws.
• Limited License: Upon enrollment, you are granted a non-exclusive, non-transferable, limited license to access and use Course Materials solely for your personal, non-commercial professional development purposes.
• Prohibited Uses: You may not:
  • Reproduce, distribute, or publicly display Course Materials without written permission
  • Use Course Materials for commercial purposes or training others
  • Modify, adapt, or create derivative works from Course Materials
  • Remove or alter any copyright, trademark, or proprietary notices
  • Share login credentials or provide access to Course Materials to unauthorized third parties
• User-Generated Content: Any capstone projects, assignments, or other content you submit remains your intellectual property. However, you grant AI Academy Asia a non-exclusive, worldwide license to use such content for educational and promotional purposes, including showcasing student work (with your permission).

8. Code of Conduct

All participants are expected to:

• Treat instructors, staff, and fellow participants with respect and professionalism
• Participate actively and constructively in course activities
• Refrain from harassment, discrimination, or disruptive behavior
• Maintain academic integrity and submit original work

We reserve the right to remove any participant who violates this Code of Conduct without refund.

9. Limitation of Liability

• To the maximum extent permitted by law, AI Academy Asia shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or business opportunities, arising from:
  • Your use of or inability to use our services
  • Application of knowledge or techniques learned in courses
  • Use of AI tools or generated content
  • Interruptions or errors in service delivery
• Our total liability to you for all claims arising from or related to these Terms or our services shall not exceed the fees you paid for the specific course giving rise to the claim.
• Some jurisdictions do not allow the limitation of liability for incidental or consequential damages. In such jurisdictions, our liability is limited to the greatest extent permitted by law.

10. Indemnification

You agree to indemnify, defend, and hold harmless AI Academy Asia, its affiliates, officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, costs, or expenses (including reasonable attorneys' fees) arising from:

• Your violation of these Terms
• Your use of our services or Course Materials
• Your violation of any rights of third parties
• Your application of knowledge or techniques learned in our courses

11. Disclaimers

• Our services and Course Materials are provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement.
• We do not warrant that our services will be uninterrupted, error-free, or completely secure.
• We make no guarantees regarding specific learning outcomes, career advancement, or professional success.

12. Modifications to Terms

We reserve the right to modify these Terms at any time. Changes will be effective immediately upon posting to our website with an updated "Last Updated" date. Your continued use of our services after such changes constitutes acceptance of the modified Terms. We encourage you to review these Terms periodically.

13. Termination

• We reserve the right to suspend or terminate your access to our services at any time, with or without cause, including for violation of these Terms.
• Upon termination, your right to access Course Materials will cease immediately.
• Provisions that by their nature should survive termination (including intellectual property rights, disclaimers, and limitations of liability) will remain in effect.

14. Governing Law and Dispute Resolution

• These Terms shall be governed by and construed in accordance with the laws of the applicable jurisdiction, without regard to its conflict of law provisions.
• Any disputes arising from these Terms or our services shall first be addressed through good-faith negotiation. If negotiation fails, disputes shall be resolved through arbitration or court proceedings in the applicable jurisdiction.

15. Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will continue in full force and effect. The invalid or unenforceable provision will be replaced with a valid provision that most closely reflects the original intent.
